Digital Millennium Copyright Act (DMCA) Policy

This page explains how XFanStream (“we”, “our”, “us”) at https://www.xfanstream.com handles copyright complaints under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and similar laws. We respect the intellectual property rights of others and expect our users to do the same.

Important notes

  • We host and/or display user-submitted content. We do not pre-screen all uploads.
  • We promptly remove or disable access to allegedly infringing material upon receipt of a valid DMCA notice.
  • We terminate the accounts of repeat infringers in appropriate circumstances.
  • We will not act on incomplete notices or bulk reports that do not identify specific URLs as required below.
  • Nothing on this page is legal advice.

1) Designated DMCA Agent

Send DMCA notices and counter-notices to our designated agent:

For fastest processing, email is preferred. Notices sent to other channels (support tickets, social media, WHOIS, etc.) may be ignored.

2) Before you submit

  • Verify ownership: Only the rights owner or an agent authorized to act for the owner may submit a notice.
  • Identify the exact content: We need the precise URL(s) on xfanstream.com of the content you claim is infringing. Homepages, search pages, category pages, or generalized “all content by X” claims are not actionable.
  • One work per notice is preferred. If reporting multiple works, clearly separate each work and its corresponding URL list.
  • Fair use and licensed use: Consider whether the use is authorized by law (e.g., fair use) or by license. Submitting false claims may expose you to liability under 17 U.S.C. § 512(f).

3) What a valid DMCA notice must include

Your notification must be a written communication that includes all of the following (17 U.S.C. § 512(c)(3)):

  1. Identification of the copyrighted work claimed to have been infringed.
  2. Identification of the material that is claimed to be infringing, with enough detail to allow us to locate it on the service:
    • Direct, full URL(s) to each specific page on https://www.xfanstream.com where the content appears.
    • If your claim concerns a video, include any relevant timecodes.
  3. Your contact information: full legal name, organization (if any), mailing address, telephone, and email.
  4. Both statements (exact or substantially similar):
    “I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
    “The information in this notification is accurate and, under penalty of perjury, I am the owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.”
  5. A physical or electronic signature of the copyright owner or authorized agent (typed full name is acceptable for electronic signature).
  6. Optional but helpful: documentation of your ownership (e.g., registration number, links to the original source, license agreements).

Format and submission guidelines that speed up processing

  • Use email (dmca@xfanstream.com) with subject “DMCA Notice – [Work Title/Identifier]”.
  • Provide URLs in plain text, one per line.
  • Maximum 50 URLs per notice. For more, submit additional notices grouped by work or title.
  • Attach supporting documents as PDF where possible.

4) What happens next (notice-and-takedown)

  • We will acknowledge receipt and review your notice for completeness.
  • If valid, we will remove or disable access to the material and notify the uploader (when applicable).
  • We may request additional information if necessary to verify your claim.
  • We may restore the material if we receive a valid counter-notification (see below).

5) Counter-notification (if you believe a removal was a mistake)

If your content was removed and you believe it was due to a mistake or misidentification, you may send a counter-notice to the Designated Agent. A valid counter-notice must include:

  1. Identification of the removed material and the location at which it appeared before it was removed (the exact URL on xfanstream.com).
  2. Your contact information: full legal name, address, telephone, and email.
  3. The following statements:
    “I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if outside the United States, to the jurisdiction of the courts located in [Specify: any judicial district in which XFanStream may be found].”
    “I will accept service of process from the person who provided the original DMCA notification or an agent of such person.”
    “I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.”
  4. Your physical or electronic signature (typed full name is acceptable).

Upon receipt of a valid counter-notice, we may forward it to the original complainant and restore the content within 10–14 business days unless the complainant notifies us that they have filed court action to restrain your use of the material.

6) Repeat infringer policy

We may suspend or terminate accounts of users who are the subject of multiple valid infringement notices. We also reserve the right to remove content and take action against any account that violates our Terms of Service, regardless of DMCA status.

7) Misrepresentations and abuse

Submitting materially false claims (or counter-claims) can result in liability, including costs and attorneys’ fees under 17 U.S.C. § 512(f). We may restrict or block senders who repeatedly submit defective or abusive notices, automated spam, or notices lacking required information.

8) Non-DMCA requests

  • Trademark complaints: Provide registration details and the specific URLs affected.
  • Privacy or other issues: Use our general contact channels or applicable forms; DMCA is not the correct pathway for non-copyright issues.

9) Jurisdiction and contact

This policy is intended to comply with the DMCA and similar regimes. Rights holders outside the U.S. should provide equivalent information required by their local law in addition to the elements listed above.
